The attached lawsuit was filed in Hamilton County Tennessee to stop the recall of the Mayor of Chattanooga. The suit asks the Court to stop the Election Commission from moving forward with the recall election stating that the Election Commission's acts are in violation of state law. The suit also questions the format of the Recall Petition. UPDATE: Recall answer has been filed by the Hamilton County Election Commission. The answer is posted below. UPDATE: The fur is flying, the petitioner who began the recall now wants to be a part of the suit to stop the recall. The Folkner key pleadings are below.
